Terms & Conditions for Free installation Promotion

These Terms and Conditions will govern your participation in the promotion on installation vouchers on selected Samsung midwall split aircon units (“Promotion”). You are deemed to have read and consented to these terms and conditions prior to entering into this Promotion. Please refer to this website for the current Terms and Conditions for the Promotion (www.samsungair.co.za).

All participants during the term of the Promotion agree to be bound by the following terms and conditions:

1. The Organizer of the Promotion is Fourways Airconditioning Pty Ltd T/A Fourways Group (“Organizers”).

2. The Promotion will run from 17 April 2023 (00h00) to 6 June 2023 (23h59) or while stocks last, whichever comes first (“the Promotion Period”). The duration of the Promotion may be extended or curtailed at the discretion of the Organizers. The promotion is only valid while stocks last, and the number of free installations is limited.

3. To be eligible to participate in this Promotion the participant must;

• • Be a natural person 18 years or older
  • be citizens of the Republic of South Africa and /or legal residents of the aforesaid country.
  • be currently residing in the Republic of South Africa at the date of the commencement of the Promotion Period.

4. The Promotion will afford the participant a voucher towards the cost of the installation upon purchase of any indoor and outdoor Samsung Room Air Conditioner as stipulated and will be specific to models listed only, subject to stock availability and voucher availability.

5. The value of the free installation is as per stipulated in these terms and conditions.

6. This Offer is only applicable to back-to-back installation with a 3-metre pipe length, any pipe longer than mentioned length will be for the participants account as quoted by the aircon dealer/installer

7. The value of the back-to-back installation voucher (i.e. indoor unit located on the other side of the wall opposite the outdoor unit) with available plug point is R2300.00 (incl. VAT) or R2800.00 (incl. VAT) depending on the model of the aircon unit as stipulated in these t’s and c’s.

8. The cost of this back-to-back installation includes the following:
a) Up to 3metres of refrigerant piping, drainpipe and cable
b) Outdoor mounting bracket (if required)
c) Installation to a maximum height of 3metres above ground level
d) Drilling of one hole for piping
e) Holes will be filled but not painted

9. The installer will quote for all costs in addition to the 3metre back-to-back installation which will include but are not limited to the following:
a) Any required piping and cabling in addition to the piping and cabling referred to above, or electrical connection to the main switchboard
b) Travelling expenses in the event of the installation being out of a 30km radius from where the unit was bought
c) Any other extras, including but not limited to:
i) external isolators and additional electrical work required
ii) any additional refrigerant piping, insulation, drainpipe and cable
iii) trunking to cover piping

10. Please note costs of isolators are not included in the installation fee. Isolator switches are a regulation requirement and are not included in the cost of the installation. A qualified electrician must install an isolator at your own cost. He must install the isolator not more than 2metres from the condenser and within view of the condenser. The cost of this is in addition to the installation cost of the unit and must be paid directly to the electrician. Indoor and outdoor units must always be earthed.

11. All electrical work including electrical isolators are not included in this Offer. There will be no trunking offered for the pipe work. Those would be additional and for the customer’s account.

12. Any additional costs not included in the value of the voucher installation amount will be for the consumer’s own account

13. This Offer is provided at the sole discretion of the Organizer and prizes must be taken up (or rejected) as advertised and may not be exchanged for cash or transferred to any other person.

14. Air conditioning unit models included in this promotion are as follows and only applicable on sets, installation amounts are as per list below

15. The free installations are limited and subject to availability

16. The free installations are not applicable on any specific negotiated bulk deals and can only be claimed by the consumer who purchased the aircon unit

17. Information regarding the Promotion that is published on authorized advertising material will also form part of the terms and conditions of the Promotion.

18. The Organizers may in their sole discretion amend these terms and conditions at any time, without notice, and such amendments shall be deemed to have taken effect from the date of publication of the revised terms and conditions on the Organizers website www.samsungair.co.za

19. The Organizers reserves the right to cancel, suspend or terminate this Promotion, without notice at any time and no liability shall lie against the Organizers in favour of any participant and/ or third party arising from such cancellation, suspension or termination. Therefore, the participant waives his/her right which they may have against the Organizers and hereby acknowledge that they will have no right of recourse or claim of any nature whatsoever against the Organizers.

20. To the extent permitted by law, the Organizers exclude all warranties (express or implied), representations and liabilities regarding this Promotion (other than for death or personal injury caused by its negligence and/or fraud).

21. This Promotion is governed by these terms and conditions, as well as those of the relevant authorized participating service providers, associated with this promotion. The participant hereby indemnifies the Organizer against any direct, indirect, special, incidental, consequential or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise.

22. Any dispute or claim arising out of or in connection with the Promotion shall be governed by and construed in accordance with the laws of South Africa.

23. The Organizers, their directors, members, partners, employees, agents, installers, consultants, any other person who directly or indirectly controls or is controlled by them or any supplier or installer or dealer of goods and services in connection with the Promotion and their spouses, life partners, parents, children, siblings, business partners or associates are not eligible to participate in or enter the Promotion.

24. Upon clicking through to a third-party website the participant must read the terms & conditions and privacy policies published on the third party website. The Organizer has no control over such websites, products or services, and will not be legally responsible to the participant for any loss or damage they suffer, whether directly or indirectly, because of the use of the website, product or service. The participant agrees that if it access the websites and/or places reliance on the information contained therein, the participant does so entirely at its own risk.

25. If part or all of any clause of these Terms and Conditions is illegal, invalid or unenforceable:

• It will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible;
• It will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.
